Agreement to these terms

These Terms & Conditions (“Terms”) govern your use of howdypest.com and any quote request, call, email or other communication you start through it (together, the “Website”). The Website is operated by Howdy Pest LLC (“Howdy,” “we,” “us,” or “our”), a household pest-control company based in Phoenix, Arizona. By using the Website, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Website. You must be at least 18 years old to request service.

Text messaging (SMS) terms

Program name. Howdy Pest Co. Alerts & Offers. By opting in, you agree to receive text messages from Howdy Pest LLC (“Howdy Pest Co.”) at the mobile number you provide.

What you’ll receive. There are two types of texts, and you choose each one separately. Service texts are about your inquiry and service, including quote follow-ups, appointment confirmations and reminders, technician arrival notices, service recaps, and billing and account notifications. Promotional texts are occasional marketing messages, such as seasonal offers, discounts, referral rewards and news from Howdy. We send promotional texts only if you specifically opt in to them.

How you opt in. By checking the service-text box, the promotional-text box, or both on our quote request form at howdypest.com/request-a-quote, or by giving consent verbally or in writing when you schedule service with Howdy. Each consent is optional and separate. Consent to receive texts, including promotional texts, is not a condition of purchasing any service.

Message frequency. Message frequency varies. Service texts depend on your service schedule and account activity; promotional texts are occasional, typically no more than a few per month.

Costs. Message and data rates may apply.

Opting out. You can cancel at any time by replying STOP to any message. After you send STOP, we will send you a one-time confirmation that you have been unsubscribed, and you will receive no further text messages from Howdy unless you opt in again. To stop only promotional texts and keep service texts, contact us at the email or phone number below.

Help. Reply HELP to any message for assistance, or contact us at hello@howdypest.com or (602) 905-9365.

Carriers. Carriers are not liable for any delayed or undelivered messages.

1. Information you submit

When you request a quote or contact us, you agree to give accurate, current and complete information, including your correct name, contact details and service address, and to let us know if it changes. Only request service for a property you own, rent or are authorized to arrange service for, and don’t submit another person’s information without their permission. You are responsible for everything you submit through the Website.

2. Quotes and service agreements

Submitting a form, calling or emailing does not purchase service, create a service agreement or confirm an appointment. We first review your request and confirm availability and the right scope for your home. Your written quote and service agreement govern pricing, payment, scheduling, contract length, renewal, cancellation, exclusions and any return-service policy or guarantee. If anything on the Website conflicts with your signed service agreement, the service agreement controls.

3. Service information and availability

The Website describes recurring general household pest care with monthly service visits and monthly billing, at $69/month for most homes. Your quote confirms your exact price. Calendar examples are illustrative; actual service dates depend on your start date and scheduling. Coverage depends on the property, pest, service area and agreed scope. Termite, wildlife, scorpion and rodent services and other specialist work are not included in the general household pest plan described on the Website. Please confirm your address and needs with Howdy before relying on availability.

4. No treatment instructions or emergency service

Website content is general information, not instructions for using pesticides or advice about a health concern. Always follow product labels and the instructions your Howdy technician provides. The quote form and email inbox are not monitored as an emergency service. For an immediate medical or safety emergency, call 911 or Poison Control at 1-800-222-1222.

5. Intellectual property

The Website and its content, including the Howdy name, logo, branding, text, photography, graphics, video and design, are owned by Howdy Pest LLC or its licensors and are protected by copyright, trademark and other laws. We give you a limited, personal, non-exclusive, non-transferable right to view the Website for your own information and to request service. You may not copy, reproduce, modify, distribute, publicly display or create derivative works from Website content, or use the Howdy name or logo, without our written permission.

If you send us ideas, suggestions or feedback about the Website or our services, you agree that Howdy may use them freely, without any obligation or payment to you.

6. Prohibited uses

You agree not to use the Website for any unlawful or fraudulent purpose; submit false, misleading or spam requests, or requests in someone else’s name; try to gain unauthorized access to the Website, its servers or connected systems; interfere with the Website’s operation or security, including by introducing viruses or harmful code or by bypassing spam protection; use bots, scrapers or other automated tools to access or collect Website content; imitate the Howdy brand in a way likely to confuse people; or harass, threaten or abuse Howdy staff through the Website or our contact channels.

7. Third-party services and links

The Website relies on third-party services, including Webflow for hosting and Cloudflare Turnstile for spam protection, and may link to maps, review sites, social media or other outside resources. Howdy doesn’t control these third parties and isn’t responsible for their content, availability, accuracy or privacy practices. Your use of them is at your own risk and subject to their own terms.

8. Promotions and offers

From time to time Howdy may advertise discounts, introductory pricing, referral rewards or other promotions. Each promotion is subject to its own stated terms, is available only while it runs, applies to new service unless stated otherwise, can’t be combined with other offers unless stated, and has no cash value. We may change or end a promotion at any time, except where that would conflict with an offer you have already accepted in writing.

9. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless Howdy Pest LLC and its owners, employees, technicians and agents from any claims, losses, damages, liabilities and expenses, including reasonable attorneys’ fees, arising from your misuse of the Website, your violation of these Terms, or your violation of any law or the rights of another person.

10. Disclaimer of warranties

The Website and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Howdy disclaims all warranties about the Website, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that the Website will always be available, uninterrupted, error-free or free of harmful components. Any warranty or guarantee for pest-control service is provided only in your written service agreement.

11. Limitation of liability

To the fullest extent permitted by law, Howdy and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from or related to your use of, or inability to use, the Website. Our total liability for any claim arising from or related to the Website will not exceed one hundred dollars ($100). These limits don’t apply to liability for death or personal injury caused by our negligence, to fraud, or to any liability that can’t be limited under applicable law, and they don’t change the terms of any signed service agreement.

12. Suspension and termination

We may suspend or end your access to the Website, or decline a quote request, at any time if we believe you have violated these Terms or used the Website in a way that could harm Howdy, our customers or others. Provisions that by their nature should continue, including intellectual property, indemnification, disclaimers, limitation of liability and dispute resolution, survive any termination.

13. Dispute resolution

Talk to us first. Most concerns can be resolved quickly with a conversation. Before starting any formal proceeding, you agree to send a written description of your concern to hello@howdypest.com and give us 30 days to try to resolve it informally.

Binding arbitration. If we can’t resolve a dispute informally, any dispute arising from or relating to the Website or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will take place in Maricopa County, Arizona, or by phone or video where the rules allow.

Class action and jury trial waiver. To the extent permitted by law, you and Howdy each agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective or representative proceeding, and each of us waives the right to a jury trial.

Service agreements. If your signed service agreement contains its own dispute-resolution terms, those terms govern disputes about your service.

14. General provisions

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Subject to the dispute-resolution section, any court proceeding will be brought in the state or federal courts located in Maricopa County, Arizona. You may not assign or transfer your rights under these Terms; Howdy may assign them as part of a merger, sale or reorganization. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, our Privacy Policy and any signed service agreement are the entire agreement about the Website, and the service agreement controls on any question about your service.

15. Changes to these terms

We may update these Terms from time to time by posting a revised version on this page and changing the “Last updated” date above. Changes take effect when posted and apply to your use of the Website after that date. Continuing to use the Website means you accept the revised Terms.
